I have heard of this. As the actionscript that you have developed is the
intellectual property of your employer. However, just a few minor changes to it
should be acceptable to the courts, and I don't think anyone would bother to
sue over an actionscript. I don't think that the next "Killer App" is going to
be written in Action script. And let's face it, most interesting or complex
things done in actionscript are usally put up for public knowledge on forums
like this one.
