You think a little banner at the bottom of an email is bad, check this out:

There's also a very good piece in this weeks http://www.iconocast.com about
email marketing and its response rates...some very interesting facts about
how well it works.

They also talk about the Opt-In alliance, where direct marketers can swap
lists on a one-name for two basis. My first reaction is "oh god not more
badly targeted marketing emails", but I can see the strengths. From a DM
perspective this is incredibly powerful, especially given the conversion
rates, but do I trust their targeting?
