The DPA 1998 which came into force in March this year requires that people
tick a box to say that they want to receive certain information (not that
they must uncheck it), it must also be very clear what the purpose of the
collection of the data is for and who will have access to it, it is also
very good practice to put the data protection lock symbol on the form to
show compliance with the ACT.

This is kind of bad news for people trying to collect peoples email
messages, but good news in that there is less wastage and less people are
going to get p****d off.

Here are the details:
The data protection act 1998 came into force on March 1 2000. The Guidelines
produced by the Data Protection Registrar to explain the Data Protection
Principles give a number of conditions and tests to apply. In particular,
the ISP should look for positive answers to all the following questions:
* Were people aware that their email address was being collected?
* Is the email being sent obviously connected to the collection of the
address?
* Was there a way of "opting out" from receiving email?
* Is there a way for the recipient of the email to revoke their previous
permission?

Can anyone clear up this query for me?
What are the legal requirements regarding opt-in and opt-out boxes. Even
though opt-out boxes are more effective, I've heard that they are frownd
upon.
