I don't know which implementation of the MPEG spec you're comparing it to
(these various implementations are often extremely hardware-dependent!) but
Macromedia Flash uses the licensed Fraunhofer audio compressors for MPEG 2
Layer 3 that were first deployed by Macromedia Shockwave, and later used in
many of the "generic-MP3" files that started to subsequently appear.
